Earned Settlement: What the Government’s Proposals Mean for Social Care

The House of Commons Home Affairs Committee has published its report on the Government’s proposed Earned Settlement reforms — changes that could significantly impact thousands of care workers and their families.

Key points:
• The standard timeframe to secure Indefinite Leave to Remain (ILR) is proposed to rise from 5 to 10 years.
• New minimum income requirements could prevent many low‑paid workers from ever being eligible.
• Care workers — already facing challenging pay and conditions — would be disproportionately affected.
• Delays to settlement may reduce Government costs in the short term, but risk increasing exploitation, poverty and workforce instability in adult social care.
• The Committee raises serious concerns about the impact on children, especially those approaching age 18.
• Transitional protections for those already in the UK remain unclear.

With the social care sector already experiencing intense workforce pressures, YHCAA echoes the Committee’s call for the Government to fully assess the implications for social care, ensure protections against exploitation, and commit to improving pay and conditions for all workers.
